  3. Communication: To respond to your inquiries, provide updates on your mortgage application, send relevant information about our services, and communicate with you by phone, email, or SMS as appropriate.
  4. Regulatory Compliance: To fulfill our legal and regulatory obligations, including those imposed by the Autorité des marchés financiers (AMF), anti-money laundering regulations, and other applicable laws governing mortgage brokerage in Quebec.
  5. Service Improvement: To analyze trends, improve our services, enhance our website functionality, and better understand the needs of our clients.

We will not use your personal information for any purpose other than those stated above without first obtaining your consent, unless permitted or required by law.

4. Means of Collection

  • Credit Bureaus: With your prior, informed, and explicit written consent, we request credit reports from Equifax Canada and/or TransUnion Canada to assess your creditworthiness.

In all cases, we collect only the personal information that is necessary for the identified purposes, and we inform you of the purposes at the time of collection.

5. Third Parties with Access to Your Personal Information

We may share your personal information with the following categories of third parties, solely for the purposes described in this policy:

Service-Related Third Parties

  • Lenders and Financial Institutions: Banks, credit unions, trust companies, and other mortgage lenders to whom we submit mortgage applications on your behalf. Information is shared only with lenders you have approved and only to the extent necessary to process your application.
  • Credit Bureaus: Equifax Canada and TransUnion Canada, solely with your explicit written consent, to obtain credit reports necessary for mortgage evaluation.

Regulatory Authorities

  • Autorité des marchés financiers (AMF): As a licensed mortgage broker (Certificate No. 254937), we are subject to oversight by the AMF and may be required to disclose information in connection with regulatory inquiries, audits, or compliance obligations.

Technology Service Providers

  • Telnyx: Our SMS communication provider, which processes text messages sent to and from our "Text us" feature. Telnyx processes your phone number and message content to deliver SMS services.
  • Google Analytics: Used to collect anonymized website usage data to help us understand how visitors use our website. Analytics cookies are only activated with your explicit consent. You may withdraw consent at any time through the cookie settings on our website.
  • Vercel: Our website hosting provider. Vercel processes technical data (such as IP addresses) as part of hosting and delivering our website.
  • CookieYes: Our cookie consent management platform, which allows you to manage your cookie preferences on our website.

We require all third-party service providers to handle your personal information in accordance with applicable privacy laws. We do not sell your personal information to any third party.

6. Retention of Personal Information

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, or as required by law.

  • Client Files: Personal information related to mortgage transactions is retained for a minimum of seven (7) years following the date of the last transaction or the end of the business relationship, in accordance with financial services regulatory requirements and applicable limitation periods.
  • Website Data: Automatically collected website data (cookies, analytics) is retained in accordance with the retention periods specified in our cookie policy and by Google Analytics (typically 14 to 26 months).
  • Inquiry Records: Information from general inquiries where no business relationship is established is retained for a maximum of two (2) years, then securely destroyed.

Upon expiry of the applicable retention period, personal information is securely destroyed or rendered anonymous using methods appropriate to the sensitivity of the information. Electronic records are permanently deleted, and physical documents are securely shredded.

7. Your Rights

Under Quebec's Law 25 and other applicable privacy legislation, you have the following rights regarding your personal information:

Right of Access

You have the right to request access to the personal information we hold about you. We will respond to your request within thirty (30) days of receipt.

Right to Rectification

You have the right to request the correction of any personal information that is inaccurate, incomplete, or equivocal. You may also request the deletion of information that is not necessary for the purposes for which it was collected, or add comments to your file.

Right to Withdraw Consent

You have the right to withdraw your consent to the collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions and upon reasonable notice. Please note that withdrawing consent may limit our ability to provide certain services to you. We will inform you of the consequences of withdrawal upon receiving your request.

Right to Data Portability

As of September 2024, you have the right to request that your personal information be communicated to you in a structured, commonly used technological format, or that it be transferred directly to another person or organization authorized to collect such information, where technically feasible. This right applies to information you provided directly to us.

Right to Be Informed

You have the right to be informed of the existence and use of automated decision-making technology, if applicable, and the right to have any such decision reviewed by a human.

Right to De-Index

You have the right to request that any hyperlink attached to your name that provides access to information by technological means be de-indexed, where the link contravenes the law or a court order.

The CAI is the independent body responsible for overseeing compliance with privacy legislation in Quebec. You may file a complaint with the CAI at any time; however, we encourage you to contact us first so that we may attempt to resolve the matter directly.


Confidentiality Incident Protocol

In accordance with Law 25, Anthony King — Architectes Hypothécaires maintains a confidentiality incident register. In the event of a confidentiality incident involving your personal information that presents a risk of serious injury, we will:

  1. Take reasonable measures to reduce the risk of injury and prevent further incidents of the same nature.
  2. Notify the Commission d'accès à l'information du Québec (CAI) promptly.
  3. Notify you of the incident, its circumstances, the information concerned, and the measures taken, unless doing so would impede an investigation to prevent, detect, or suppress a crime or statutory offence.
